1. Parties and Scope

These Terms of Service govern the Linguru mobile application ("the App") operated by Erhal Olcel (individual developer, İstanbul, Türkiye). By downloading the App or creating an account, you accept these terms.

2. Age Requirement and Account

The App is for users aged 16 and above. You must be at least 16 years old to create an account. You are responsible for the accuracy of the information you provide.

Each user may have only one account. You are responsible for keeping your password confidential and for all actions performed through your account.

3. Services Provided

The App offers:

Daily English lesson content (Topics)
Interactive games including Word Hunt, Taboo, Werewolf
Daily tips, surveys, and announcements
Cambridge-based placement test
With premium subscription: 28-Day Speaking Marathon and audio recording evaluation

Services may be improved, modified, or discontinued from time to time. Material changes are notified in advance.

4. User Obligations

By using the App you agree not to:

Submit unlawful, defamatory, or harassing content
Reverse engineer the App's source code or use automated bots/scripts
Misuse another user's account, information, or identity
Submit audio containing individuals who have not consented
Infringe copyright, trademark, or any other intellectual property right
Spam, launch DoS/DDoS attacks, or harm the service

Accounts violating these rules may be suspended or terminated without prior notice.

5. Premium Subscription, Payment, and Refunds

Premium features (28-Day Speaking Marathon, audio evaluation, class assignment, etc.) are offered via paid subscription.

Payment: Payments are processed via Paratika (Asseco SEE) secure payment infrastructure. Card details are never stored on our servers.
Billing: Subscriptions renew automatically at the end of the selected term (monthly/yearly). If not cancelled at least 24 hours before renewal, your payment method is charged.
Cancellation: You may cancel your subscription at any time via in-app settings or through App Store / Google Play subscription management. Cancellation takes effect at the end of the current billing period — you retain access for the remaining period.
Refunds: Under Turkish Distance Sales Regulation, once the digital service has been accessed (first premium content accessed), the right of withdrawal ends. For unused subscriptions you may request a refund within 14 days by emailing destek@linguru.com.tr.
Price changes: Any price change is announced in advance and is not applied to your existing subscription without consent.

6. Intellectual Property

The App's source code, design, logo, and content (lesson text, tips, game designs, etc.) are protected by copyright and operated by Erhal Olcel. They may not be copied, distributed, or modified for non-personal purposes.

Content you submit (audio recordings, messages, survey responses) remains your intellectual property. However, you grant us the right to process this content for evaluation, improvement, and legal compliance purposes.

7. Account Deletion

In-app (recommended): Profile > Delete Account — a two-step confirmation deletes your account immediately.

If you no longer have the app installed or can't sign in: Email us from your registered email address at destek@linguru.com.tr with the subject "Account Deletion Request". After identity verification, your account and all personal data are permanently deleted within 30 days; you receive an email confirmation when done.

What is deleted: name, email, phone, avatar photo, submitted audio recordings, in-app progress (lessons, streak, points, level), read/dismissed notification history, survey responses, feedback messages, device push token.

What is retained: Payment records — required to be kept for 10 years under Turkish tax law (Article 253, Tax Procedure Law). These are also automatically deleted at the end of that period.

Cancellation and refunds: For active premium subscriptions, the refund terms in Section 5 apply before deletion. A deletion request does not automatically cancel your subscription — you must first cancel via App Store / Google Play subscription management.

8. Service Changes and Downtime

Content and technical infrastructure are updated periodically. Scheduled maintenance is announced in advance. We are not directly liable for damages arising from unplanned outages, but access is restored as quickly as possible.

9. Limitation of Liability

The App is provided "as-is". No express or implied warranty is given that English learning progress will be achieved — outcomes vary by individual.

Erhal Olcel is not liable for indirect, incidental, or special damages arising from App use; data loss; loss of profit; or reputational harm. Total liability for direct damages is limited to the total payments made by the affected user in the preceding 12 months.

10. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Türkiye. Disputes shall be resolved before the Istanbul Central (Çağlayan) Courts and Enforcement Offices. For consumer users, Law No. 6502 on Consumer Protection provisions are reserved — including access to consumer arbitration committees and consumer courts.

11. Changes

These terms may change. Material changes are announced in-app; continued use constitutes acceptance of the updated terms.
